GURUGRAM, June 19, 2026 — A consumer commission orders a refund of Rs 26,000 after a restaurant added an undisclosed 10 percent service charge to a bill without clear consent, ruling the practice unlawful.
The Gurgaon Consumer Commission on June 2 directed Big Pitcher restaurant to refund the full service charge amount with interest and pay Rs 15,000 in compensation plus Rs 11,000 for litigation costs after finding the service charge was applied in violation of consumer protection guidelines.
Consumer Law and Restaurant Billing
The commission noted that the invoice for a meal on May 15 showed a 10 percent service charge added automatically, which the diner had not been informed about or agreed to before paying. Under the Central Consumer Protection Authority (CCPA) guidelines, mandatory service charges are considered an unfair trade practice.
The bench, led by presiding member Sanjeev Jindal, held that automatically levying service charges without clear disclosure and consent constituted deficient service and an unfair trade practice. The guidelines make clear that service charges must be voluntary and optional for consumers.

This ruling reinforces consumer protections by affirming that restaurants cannot impose hidden charges without explicit prior notice. Consumers who encounter similar billing practices may seek assistance through the National Consumer Helpline at 1915 or their state helpline.
“It is clear that the restaurant not only provided deficient service but also engaged in an unfair trade practice,” the commission said in its order.
